    1.

    The schedule of fines for Ordinance Number 3057 (Regulation of the Production of Noise), section 401(1) [Code of Ala. 1995, § 78-118], is hereby adopted as follows:

    First violation $100.00
    Second and subsequent violations  200.00

     

    2.

    All other requirements and regulations of Ordinance Number 3057 will hereby remain in full force and effect.

    3.

    The schedule of fines for section 98-192 Code of Ordinances, City of Bessemer, (Abandoning a motor vehicle) is hereby adopted as follows:

    First violation $ 50.00
    Second violation  100.00
    Third violation  150.00
    Fourth violation  200.00

     

    4.

    All other requirements and regulations of section 98-192 Code of Ordinances, City of Bessemer, will hereby remain in full force and effect.

    5.

    The schedule of fines for section 90-36 Code of Ordinances, City of Bessemer, (Accumulation of rubbish) is hereby adopted as follows:

    First violation $100.00
    Second and subsequent violations  200.00

     

    6.

    All other requirements and regulations of section 90-36 Code of Ordinances, City of Bessemer, will hereby remain in full force and effect.

    7.

    The schedule of fines for section 90-2 Code of Ordinances, City of Bessemer, (Dumping on streets and thoroughfares) is hereby adopted as follows:

    First violation $250.00
    Second violation  500.00

     

    8.

    All other requirements and regulations of section 90-2 Code of Ordinances, City of Bessemer, will hereby remain in full force and effect.

    9.

    The schedule of fines for section 14-4 Code of Ordinances, City of Bessemer, (Dogs running at large) is hereby amended as follows:

    First violation $100.00
    Second violation (within 2 years)  200.00

     

    10.

    All other requirements and regulations of section 14-4 Code of Ordinances, City of Bessemer, will hereby remain in full force and effect.

    Chapter 14

    ANIMALS

    ARTICLE I. IN GENERAL

    Sec. 14-4. Penalty amounts.

    The minimum penalty or fine for violations of this chapter shall be as follows:

    (1)

    Failure to procure a license tag (section 14-51): $25.00

    (2)

    A noisy dog (section 14-56): $25.00

    (3)

    A dog running at large within the corporate limits of the city (section 14-58): $25.00

    (4)

    Violation of the leash law (section 14-60): $25.00

    ARTICLE II. DOGS

    Sec. 14-53. Same—Fee; vaccination certificate.

    Pursuant to subsection 14-53(d) of the Code of Ordinances of the City of Bessemer the following fee and fine schedule pertaining to dogs situated within the City of Bessemer, is set as follows:

    (1)

    The annual dog tag issuance fee required under subsection 14-53(a) is set at $5.00 for each dog up to a maximum of five dogs.

    (2)

    The annual dog tag issuance fee required under subsection 14-53(b) is set at $30.00 maximum where five or more dogs all belonging to the same person are in the same kennel, humane society or pet shop.

    (3)

    The delinquent fee required under section 14-54 is set at $10.00 for each dog tag issuance fee not paid by the last day of February.

    (4)

    The minimum penalty or fine for violation of chapter 14 is hereby established at $25.00 as required under section 14-4.

    Chapter 18

    BUILDINGS AND BUILDING REGULATIONS

    ARTICLE VII. HOUSING CODE

    Sec. 18-177. Schedule of minimum penalties and fines for violations of housing code; citations.

    (a)

    There is hereby established a schedule of minimum penalties and fines for violations of offenses defined in the housing code of the city and for the dumping of rubbish or spilling loads from trucks onto city streets or in an unauthorized place within the city limits. The schedule of fines is as follows:

    (1)

    Defective or nonapproved garbage container: $2.00.

    (2)

    No garbage container: $5.00.

    (3)

    A person storing rubbish on his premises: $10.00.

    (4)

    Truck or vehicle dumping rubbish in an unauthorized place: $20.00.

    (5)

    Truck spilling loads onto city street: $20.00.

    (b)

    The city clerk and treasurer is hereby authorized to have printed appropriate citations which reflect the foregoing fines and which may be given by any city employee upon the observation of any violation of the provisions of subsection (a) of this section.

    Chapter 62

    HEALTH AND SANITATION

    ARTICLE VII. SMOKING IN PUBLIC PLACES

    Sec. 62-103. Violation; penalty.

    (a)

    Any person who willfully smokes in an area where smoking is prohibited under this article; or any business proprietor or person in charge of a public place who fails or refuses to designate smoking and nonsmoking areas as required herein, or who refuses to enforce the designation, shall be in violation of this article.

    (b)

    It shall be unlawful to violate any of the terms and provisions of this article. Any person violating any of the terms and provisions of this article shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine not less than $25.00 nor more than the maximum penalty allowed by the state for a misdemeanor violation for each such offense. On each occurrence any violation of this article shall continue shall constitute a separate offense.
